According to a rule of traditional logic concerning the relation between general (or universal) concepts, if a given concept is more general than a second one, then the opposition (or contradictory) of the first concept is more specific than the opposition (or contradictory) of the second one. Kātibī, one of the Muslim logicians in the 13th century, has raised a question against this rule and, by giving some counterexamples, claims that it results in contradiction. Some Muslim logicians have replied to (...) Kātibī, and in this paper I have examined their replies. Also, by using rules of modern logic, we may easily show that either Kātibī's argumentation is fallacious or it does not result in contradiction; however, it seems that if modern logic rules had been represented to Muslim logicians, some of those rules would have been rejected by them. According to Aristotelian logic, in categorical logic, there are three kinds of judgements (qaḍīyya): affirmative, negative, and metathetic (ma‘dūla). Khūnajī, a famous Muslim logician in the 13th century, introduces a different judgement (or statement) entitled “affirmative judgement with the negative predicate” (mūjiba al-sāliba al-maḥmūl; henceforth, ANP judgement). Although in the Arabic language, formally, ANP judgement is similar to definite negative (sāliba muḥaṣṣala) and also metathetic judgements, the way of its construction is different from both of them and its truth conditions (...) are different from metathetic ones. From a modern logic viewpoint, ANP may indicate equality judgement; however, attributing it to Muslim logicians is questionable, although some of their wordings may implicitly show it. According to Ḥāʾirī, an Iranian contemporary philosopher and logician, the new judgement is supposed to solve some problems, especially logical explanation of the division of modalities into necessity, impossibility, and contingency (imkān khāṣṣ). However, Ṭabāṭabāʾī, another Iranian contemporary philosopher, disagrees with Ḥāʾirī and regards ANP judgement the same as an affirmative metathetic one. In this paper, while examining Ṭabāṭabāʾī’s and Ḥāʾirī’s reasons, by using some insights into modern logic, I will try to strengthen Ṭabāṭabāʾī’s views, although it may be confronted with some questions or deficiencies. One of Kripke’s innovations concerning the philosophy of language is the doctrine that the truth of some metaphysically necessary propositions is only known a posteriori. The typical example he gives is the identity statement consists of two different proper names that refer to the same referent, like “Hesperus = Phosphorus”. By metaphysically necessary he means that the proposition is true in all possible worlds and by a posteriori knowledge he means that its truth is known by experiment or investigation. Some (...) philosophers have given arguments against Kripke’s doctrine and claimed that such propositions can, also, be known a priori. In this paper, I will defend Kripke’s view by showing that his approach to the issue is linguistic not metaphysical, opposite to his critics. (shrink)

The present study contributes to developing a pragmatic constructivist framework for detecting the nature of real-world’s problems. To do so, we developed a framework that appreciates factual and logical aspects of reality and considers the values of actors participating in the situation using their communication. This occurs by integrating contingency theory and sense-making theory, which utilize rational and discursive inference mechanisms, respectively. In order to effectively cope with the complexity of understanding problems’ nature, it is suggested to use rational and (...) discursive mechanisms in complement. To do so, in this study, organizational information processing theory (OIPT) from contingency theory was utilized to enrich the Cynefin framework stemming from sense-making theory. Then, we used qualitative conceptual analysis to investigate Cynefin papers in a deductive-inductive way to develop the evolved Cynefin framework. The rationality of OIPT improves the analytical capabilities of Cynefin. Additionally, OIPT’s contextual factors facilitate structuring debate sessions to reach a consensus. Cynefin helps us extract contextual narrations, which enables the acquisition of new knowledge. OIPT tries to extract actors’ existing explicit and tacit knowledge. Finally, the developed framework is validated by utilizing it in the field of business process management and discussing how it helps problem-solvers make sense of their processes. (shrink)

The relationship between morality and law is one of the issues that has provoked considerable controversies. Among others, an important discussion is whether obeying “conventional morality” in public and/or private spheres should be legally enforced by legislators. In this paper, we will look at the controversies over the issue of the “legal enforcement of morality” in the well-known debate between Herbert Hart and Patrick Devlin. In light of Richard Hare's moral philosophy, we will begin by distinguishing three realms of morality. (...) We will then clarify Deviln's view on “conventional morality”, employing the terminology derived from Hare's moral philosophy. After elaborating the implications, consequences, and roots of “conventional morality” in Devlin's view, we will turn to the relation between law and “conventional morality”. Finally, we will criticize Devlin's approach and highlight our objections to his account. By showing the flaws of Devlin's conception of “conventional morality,” we will challenge her legal view of morals. (shrink)

Muslim scholars have had different approaches toward modern technologies. Defining the situation in various Islamic countries is dependent on knowing the approaches adopted by their scholars. These approaches create norms which can shed light on the reasons for the success and failure of access to technology and its transference. The present article sets out to analyze the views of the Qom seminary scholars in Iran about the development of modern technologies within the framework of the development sociology using the qualitative (...) methodology of grounded theory. To this end, such techniques as conducting interviews and investigating documents have been used to gather the data. The authors find four paradigm models regarding modern technologies among the Qom seminary scholars. These models are classified into two general categories: optimistic and pessimistic. In the end, an “appropriate technology” approach is introduced as an approach singled out by the researchers. (shrink)

Linear continuous logic is the fragment of continuous logic obtained by restricting connectives to addition and scalar multiplications. Most results in the full continuous logic have a counterpart in this fragment. In particular a linear form of the compactness theorem holds. We prove this variant and use it to deduce some basic preservation theorems.

I study definability and types in the linear fragment of continuous logic. Linear variants of several definability theorems such as Beth, Svenonus and Herbrand are proved. At the end, a partial study of the theories of probability algebras, probability algebras with an aperiodic automorphism and AL-spaces is given.

The ultraproduct construction is generalized to p‐ultramean constructions () by replacing ultrafilters with finitely additive measures. These constructions correspond to the linear fragments of continuous logic and are very close to the constructions in real analysis. A powermean variant of the Keisler‐Shelah isomorphism theorem is proved for. It is then proved that ‐sentences (and their approximations) are exactly those sentences of continuous logic which are preserved by such constructions. Some other applications are also given.

We develop a model theoretic framework for studying algebraic structures equipped with a measure. The real line is used as a value space and its usual arithmetical operations as connectives. Integration is used as a quantifier. We extend some basic results of pure model theory to this context and characterize measurable sets in terms of zero-sets of formulas.

We study the relations of being substructure and elementary substructure between Kripke models of intuitionistic predicate logic with the same arbitrary frame. We prove analogues of Tarski's test and Löwenheim-Skolem's theorems as determined by our definitions. The relations between corresponding worlds of two Kripke models [MATHEMATICAL SCRIPT CAPITAL K] ⪯ [MATHEMATICAL SCRIPT CAPITAL K]′ are studied.

We study model theory of random variables using finitary integral logic. We prove definability of some probability concepts such as having F as distribution function, independence and martingale property. We then deduce Kolmogorov's existence theorem from the compactness theorem.

The linear compactness theorem is a variant of the compactness theorem holding for linear formulas. We show that the linear fragment of continuous logic is maximal with respect to the linear compactness theorem and the linear elementary chain property. We also characterize linear formulas as those preserved by the ultramean construction.

A quantified universe is a set M equipped with a Riesz space equation image of real functions on Mn, for each n, and a second order operation equation image. Metric structures 4, graded probability structures 9 and many other structures in analysis are examples of such universes. We define ultraproduct of quantified universes and study properties preserved by this construction. We then discuss logics defined on the basis of classes of quantified universes which are closed under this construction.

While there are numerous doubts, controversies and lack of consensus on alternative definitions of human death, it is argued that it is more ethical to allow people to choose either cessation of cardio-respiratory function or loss of entire brain function as the definition of death based on their own views. This paper presents the law of organ transplantation in Japan, which allows people to decide whether brain death can be used to determine their death in agreement with their family. Arguably, (...) Japan could become a unique example of individual choice in the definition of death if the law is revised to allow individuals choose definition of death independently of their family. It suggests that such an approach is one of the reasonable policy options a country can adopt for legislation on issues related to the definition of death. (shrink)

In this study, we examine investor and firm response to the California Transparency in Supply Chains Act of 2010. The CTSCA requires large retail and manufacturing firms to disclose efforts to eradicate slavery and human trafficking from their supply chains and is a rare example of mandated corporate social responsibility disclosure. Based on a sample of 105 retail companies subject to the CTSCA, we find a significant negative market reaction to the passing of the CTSCA. Furthermore, we find that the (...) reaction is significantly more negative for larger firms and companies facing greater supply chain risks, suggesting that investors place a negative value on exposure to legitimacy threats in the social domain. With respect to company disclosure response, we document relatively high compliance with the legislation, although we also find that the disclosure response appeared to be more symbolic than substantive in nature. Finally, our analysis indicates that both disclosure choice and disclosure extensiveness were significantly higher for the high-supply chain risk companies, suggesting that the response was influenced by concerns with strategic legitimation. Overall, the limited quality of disclosure suggests that, without additional rules and guidance, mandates alone may not lead to meaningful social disclosure. (shrink)

Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. This paper examines the relationship between corporate social responsibility and financial performance for Islamic banks in the Gulf Cooperation Council region over the period 2000–2014 by generating CSR-related data through disclosure analysis of the annual reports of the sampled banks. The findings of this study indicate that there is a significant positive relationship between CSR disclosure and the financial performance of Islamic banks in the GCC countries. The results also show a positive relationship between CSR disclosure and the future financial (...) performance of GCC Islamic banks, potentially indicating that current CSR activities carried out by Islamic banks in the GCC could have a long-term impact on their financial performance. Furthermore, despite demonstrating a significant positive relationship between the composite measure of the CSR disclosure index and financial performance, the findings show no statistically significant relationship between the individual dimensions of the CSR disclosure index and the current financial performance measure except for ‘mission and vision’ and ‘products and services’. Similarly, the empirical results detect a positive significant association only between ‘mission and vision’ dimension and future financial performance of the examined banks. (shrink)

In discussing the intricate and somewhat complex relationship between Shiʻism and Sufism, both in principle and essence or in their metahistorical reality as well as in time and history, we need hardly concern ourselves with the too often repeated criticism made by certain orientalists who would doubt the Islamic and Quranic character of both Shiʻism and Sufism. Basing themselves on an a priori assumption that Islam is not a revelation and, even if a religion, is only a simple ‘religion of (...) the sword’ for a simple desert people, such would-be critics brush aside as un-Islamic all that speaks of gnosis and esotericism, pointing to the lack of historical texts in the early period as proof of their thesis, as if the non-existent in itself could disprove the existence of something which may have existed without leaving a written trace for us to dissect and analyse today. The reality of Shiʻism and Sufism as integral aspects of the Islamic revelation is too blinding to be neglected or brushed aside by any would-be historical argument. The fruit is there to prove that the tree has its roots in a soil that nourishes it. And the spiritual fruit can only be borne by a tree whose roots are sunk in a revealed truth. To deny this most evident of truths would be as if we were to doubt the Christian sanctity of a St Francis of Assisi because the historical records of the first years of the Apostolic succession are not clear. What the presence of St Francis proves is in reality the opposite fact, namely, that the Apostolic succession must be real even if no historical records are at hand. The same holds true mutatis mutandis for Shiʻism and Sufism. In this paper in any case we will begin by taking for granted the Islamic character of Shiʻism and Sufism and upon this basis delve into their relationship. In fact Shiʻism and Sufism are both, in different ways and on different levels, intrinsic aspects of Islamic orthodoxy, this term being taken not only in its theological sense but in its universal sense as tradition and universal truth contained within a revealed form. In this essay Khosrow Bagheri Noaparast argues that, by focusing on acculturation and edification, Richard Rorty has provided a promising view for education because without acculturation, education turns into a destructive endeavor, and without edification, education risks the danger of being repetitive and reproductive. However, Rorty's view is problematic in terms of the characteristics he holds for acculturation and edification, as well as the incommensurable relation he maintains exists between the two. Noaparast asserts that there are three unnecessary dichotomies (...) in Rorty's educational view: sentiment versus argument, solidarity versus objectivity, and acculturation versus edification. In the case of the first dichotomy, Noaparast contends, one should combine sentiment and argument or else embrace arbitrariness in dealing with different frames of reference. As for the second dichotomy, since solidarity is vital in providing us with scientific consensus, it cannot be the alternative to objectivity. Finally, the third dichotomy would make the very idea of edification impossible to realize unless there can be a relation between the two phases of education. Noaparast concludes that Rorty's view on education holds great promise if we can find a way around these dichotomies. (shrink)

Recently, women entrepreneurship has become of particular interest to corporate social responsibility (CSR) scholarship, however, little is known about the impact of crises on women’s business activities and how they adapt to the disruptions and new market realities caused by a crisis. To design CSR initiatives that genuinely cater to the needs of women entrepreneurs, it is imperative to acquire an in-depth understanding of their unique experiences during times of crisis. This study employed a qualitative methodology to investigate the development (...) of resilience among women entrepreneurs amidst crisis. The study sample comprised Iranian women entrepreneurs who were operating health-related businesses during the COVID-19 pandemic. In addition to challenges related to money, market, management, motherhood, macro and meso level factors, women entrepreneurs were found to face crisis related challenges such as emotional exhaustion, altruism, fear of failure and uncertainty. Additionally, the findings revealed the different problem-based and emotion-based coping strategies (e.g., bootstrapping and emotional regulation) that women entrepreneurs used to build entrepreneurial resilience as well as business resilience. The resultant findings offer a comprehensive understanding of women entrepreneurs’ resilience-building process and suggest that resilience-building is a contextual as well as a gendered phenomenon. Implications for entrepreneurship research as well as women entrepreneurship and ethics literature is discussed. (shrink)

The term takyīf fiqhī stands for one crucial concept in Islamic jurisprudence and refers to one of the important steps in the process of formulating fatwā. It basically revolves around the categorization of particular issues under the appropriate rules and precedents established in Islamic juristic thought. The present article attempts to examine the concept of takyīf fiqhī in a comprehensive manner in terms of its meaning, authority, types, importance, and governing criteria as can be gleaned from the works of Sharī‘ah (...) scholars. This is then followed by an exploration of its application to modern contracts, taking as a case study the Central Provident Fund Nomination in Singapore. The article concludes with the view that the Central Provident Fund Nomination, in terms of its essential characteristics and objective, resembles the Islamic will contract as discussed in books of Islamic Jurisprudence. : The 1997 Japanese organ transplantation law is the fruit of a long debate on "brain death" and organ transplantation, which involved the general public and experts in the relevant fields. The aim of this paper is to trace the history of the implementation of the law and to critique the law in terms of its consistency and fairness. The paper argues that the legislation adopts a double standard regarding the role of the family. On the one hand, the legislation (...) overemphasizes the family's authority by granting the family a veto on the matter of organ transplantation, while, on the other hand, not allowing the family to make surrogate decisions. In addition, the role of the law in cases involving minor or incompetent patients is shown to be similarly misguided. The paper argues that accepting a decisive role for the family in current law is compatible with Japanese culture. (shrink)

In organ transplantation, the demand for human organs has grown far faster than the supply of organs. This has opened the door for illegal organ trade and trafficking including from children. Organized crime groups and individual organ brokers exploit the situation and, as a result, black markets are becoming more numerous and organized organ trafficking is expanding worldwide. While underprivileged and vulnerable men and women in developing countries are a major source of trafficked organs, and may themselves be trafficked for (...) the purpose of illegal organ removal and trade, children are at especial risk of exploitation. With the confirmed cases of children being trafficked for their organs, child organ trafficking, which once called a “modern urban legend”, is a sad reality in today’s world. By presenting a global picture of child organ trafficking, this paper emphasizes that child organ trafficking is no longer a myth but a reality which has to be addressed. It argues that the international efforts against organ trafficking and trafficking in human beings for organ removal have failed to address child organ trafficking adequately. This chapter suggests that more orchestrated international collaboration as well as development of preventive measure and legally binding documents are needed to fight child organ trafficking and to support its victims. The increasing gap between organ supply and demand has opened the door for illegal organ sale, trafficking of human organs, tissues and cells, as well as transplant tourism. Currently, underprivileged and vulnerable populations in resource-poor countries are a major source of organs for rich patient-tourists who can afford to purchase organs at home or abroad. This paper presents a summary of international initiatives, such as World Health Organization’s Principle Guidelines, The Declaration of Istanbul, Asian Task Force Recommendations, as well as (...) UNESCO’s and the United Nation’s initiatives against trafficking of human organs, tissues, cells, and transplant tourism. Beyond the summary, it calls for more practical measures to be taken to implement the existing guidelines and recommendations, in order to prevent exploitation of the poor as organ providers. The paper suggests that an international legally binding agreement in criminalizing organ trafficking would be a step forward to bring a change in the global picture of organ trafficking and transplant tourism. Recent literature on Islam and the digital covers a wide range of topics and themes; however, what is yet to be developed from an Islamic perspective is a broader philosophical framework that accounts for the nature, exigencies and affordances of contemporary digital technologies. In advance of such a framework, this article is an attempt to open the way to philosophical engagement with issues of digital ethics from an Islamic perspective. After a brief review of recent literature on Islam and the (...) digital and a significantly earlier work by Ziauddin Sardar, in which he proposed an information strategy for the Muslim world, this paper provides some background to Islamic ethics and the wide field of ethical theories in the Islamic tradition. This paper then proceeds by identifying and outlining examples of contemporary themes in Islam and the digital which conceal underlying philosophical and theological issues. Finally, this paper considers the significant scale and scope of the transformations involved in the ongoing transposition to the ‘onlife’ and highlights several areas where Islamic perspectives may be seen to converge or diverge with other strands of scholarship on digital ethics. The current ecological crisis is a matter of urgent global concern, with solutions being sought on many fronts. In this book, Seyyed Hossein Nasr argues that the devastation of our world has been exacerbated, if not actually caused, by the reductionist view of nature that has been advanced by modern secular science. What is needed, he believes, is the recovery of the truth to which the great, enduring religions all attest; namely that nature is sacred. Nasr traces the historical (...) process through which Western civilization moved away from the idea of nature as sacred and embraced a world view which sees humans as alienated from nature and nature itself as a machine to be dominated and manipulated by humans. His goal is to negate the totalitarian claims of modern science and to re-open the way to the religious view of the order of nature, developed over centuries in the cosmologies and sacred sciences of the great traditions. Each tradition, Nasr shows, has a wealth of knowledge and experience concerning the order of nature. The resuscitation of this knowledge, he argues, would allow religions all over the globe to enrich each other and cooperate to heal the wounds inflicted upon the Earth. (shrink)

Background:Emergency care providers are frequently faces with situations in which they have to make decisions quickly in stressful situations. They face barriers to ethical decision-making and recognizing and finding solutions to these barriers helps them to make ethical decision.Objectives:The purpose of this study was to identify barriers of ethical decision-making in Iranian Emergency Medical Service personnel.Methods:In this qualitative research, the participants (n = 15) were selected using the purposive sampling method, and the data were collected by deep and semi-structured interviews. Finally, the data are analyzed using the content analysis approach.Ethical considerations:Permission to conduct the study was obtained from the Ethics Committee of the Shahid Beheshti University of Medical Sciences. The objectives of the study were explained to the participants and written consent was received from them. Also, participants were assured that necessary measures were taken to protect their anonymity and confidentiality.Findings:The results of the analysis are classified in five main categories. It encompasses the following areas: perception of situation, patient-related factors, input and output imbalance, uncoordinated health system, and paradoxes.Conclusion:Emergency Medical Service personnel make ethical decisions every day. It is important that prehospital personnel know how to manage those decisions properly so that clients’ moral rights are respected. Hence, by identifying the dimensions and obstacles of ethical decision-making in Emergency Medical Service personnel, it is possible to enhance the moral judgment and ethical accountability of the personnel and develop the strategies necessary for ethical decision-making in them. This article provides the findings of a quantitative and qualitative study of participants from the prematurely cancelled Ontario Basic Income Pilot in the Hamilton region. We compare our evidence with those of other large-scale experiments from the high-income countries between 1968 and 2019 to place OBIP’s findings in the context of evidence from randomized control experiments with similar policy conditions to Ontario’s. Our study identified a small decline in labour market participation, but improvements on a variety of quality-of-life measurements. We (...) hypothesize that OBIPs comparatively positive results on general well-being can be attributed to its: i) generous benefit rates relative to social assistance rates; ii) 50 percent take back rate; and iii) unconditionality; iv) broad well-being/welfare design. The position of the philosophy of education in theoretical or practical philosophy was the main subject of debate between Paul Hirst and Wilfred Carr. In his support for practical philosophy, Carr argues that in order to bridge the theory/practice gap and deconstruct the illusory intactness of philosophy of education from developments in the practical realm, philosophy of education should be assumed as a branch of practical philosophy. Opposed to this argument, Hirst holds that philosophy of education is a second-order activity (...) and a theoretical matter. Even though both viewpoints seem to be reductive, it is argued here that the controversy of Hirst and Carr on theoretical/practical philosophy of education is more a pseudo-problem than a real one. This is because Hirst does not dismiss the reflection on action as a source of philosophical knowledge, nor does Carr in fact avoid a second-order activity in his endeavour in philosophy of education. Nonetheless, it is argued that we should celebrate a moderate dualism in the case of theoretical and practical reason. (shrink)
